Due tomorrow in the morning

The following are two scenarios that involve copyright law. For any one scenario, write a short essay, between 200 and 300 words, analyzing the situation.

There are some questions at the end of each scenario to help guide your thinking. The purpose of this exercise is not to find a correct answer-there may not be one. Rather, the purpose is for you to demonstrate your knowledge and ability to analyze a situation involving copyright issues.


Scenario 1

You are the owner of a local bakery that specializes in wedding cakes. You have just completed a college course in Marketing. You want to use what you learned to promote your business. You want to develop a public image for advertising purposes. You also have a great idea, one that will link your business with the local community in the eyes of your customers.

The new city hall building is very distinctive looking and attractive. It has won several design awards. With some imagination, you see that it also happens to look a lot like a wedding cake. Your idea is to photograph the building and, using a computer, morph the image with a wedding cake of your design. The result will be simultaneously recognizable as the city hall building and your cake, linking your business with the city.

You meet with a local printer to discuss having a set of promotional brochures printed that use your idea. He likes the idea. He says that his shop can do the whole job. You sign a deal in which the printer will do the layout, image manipulation, and printing. The photography will be done by one of his subcontractors. Five thousand dollars will get a pre-press version of the brochure for your final approval. You write the check. It is a go.

When the proof comes back, it looks fantastic. The printed brochure looks better than you had anticipated. You are about to okay a print job that costs over $30,000 to complete.
