The Cranmore Hotel, a lovely inn with a natural pond on the property, is located in the hills of a wooded suburb. During the winter, the pond freezes and neighborhood children come to play and skate on it. Toward the end of March, the ice was becoming thin. While some neighborhood children were playing, one child fell through the ice. She suffered from exposure and frostbite and was hospitalized for several days.
Will the hotel be liable for the child’s injuries? Why or why not? Is there additional information you might need to assess liability more definitively, and if so, what information would that be?
