Eighteen months ago Topple Ltd agreed to construct a new arena at
a cost of $2,000,000 for Blanktown University in Nova Scotia. The
building was to be completed within two years and payment was to
be made upon completion.
Due to a shortage of bricks, a substantial increase in the cost of
other materials, and a three month strike by its employees Topple Ltd
decided a month ago that they would be unable to complete the work
by the stipulated time and would, in any case, make a substantial loss
on the contract. Hence they ceased work on the arena and informed
Blanktown University that they would not complete the building.
Advise Topple Ltd, generally, on their legal position.

QUESTION TWO
Horatio, a garage owner, entered into separate contracts with:
Jan.30th,
a) Mogul Oil Co who agreed to supply Horatio with 5,000 liters of
Mogul Extra gasoline at $1.00 per liter.
b) Jerry Builders Ltd who agreed to construct a large repair shop with
extensive servicing facilities for Horatio.
A month before the delivery date of the gasoline Mogul informed
Horatio that they would not be able to supply the gasoline due to a
chreatened conflict in the Middle East. Horacio could have placed an
order with another firm and have obtained petrol at $1.25 a liter.
Instead he insisted on Mogul fulfilling their obligation, and when
they failed to do he had to buy gasoline from another source at $1.50
a liter.
Due to defective workmanship the roof of the repair shop built by
Jerry Builders Ltd collapsed damaging a customer’s car, and prevented
Horatio from fulfilling a highly lucrative servicing contract on a fleet
of trucks.
Advise Horatio as to what damages, if any, for breach of contract
he can recover from Mogul Oil Co and from Jerry Builders Ltd.
