How to get rid of a roommate – without committing a crime
Staying with a roommate who is not pleasant to live with is like a nightmare to anyone. A person would always think of staying outside than see him/her often, but what if it is necessary to stay around to do the lessons for school, or there is a need to prepare everything for tomorrow’s trip to school? There is no better way than plan something effective to get rid of the roommate, but without involving in trouble or doing a crime. In some cases, roommate arrangement is not as easy as that, especially if both roommates seem strange to each other. There can be cases when a small conflict could still be patched up by initiating a talk aimed at reaching an agreement. However, when a case becomes serious and there is no other way to settle the differences, one must live the premises in order to keep each one’s sanity. Whatever the source of conflict is, there is always a way to eject him/her from the room. The most important thing is that the method that will be applied should be legal based on the binding agreement between two parties concerned, and what the role of the landlord will be in the case.
Sometimes it makes sense to go direct to make things easier than keep something in the heart, and wait for the time that it boils and explodes. Tell the roommate exactly in a nice way what seems to be the problem, but do not put everything on him/her. Say that it is difficult to live with it when things are no longer working just like before. Calculate their reactions and anticipate that statement that he/she is eager to reform. However, if it is already set up that he/she should leave by all means, then, be prepared to be absolute and firm about it.
Check if both parties involved are contained on the lease, or if it lists down only one party. Review also the lease if there is any stipulation regarding roommate changes if ever a problem arises. Approach the landlord, and try to negotiate terms. Assuming that the name of the other person is not indicated on the lease, then, it is possible to demand that the roommate vacates the property. It could even be easier to get him/her off if negotiation of terms is done, like leaving the premises at a certain date. Once the negotiation is done, put the terms in writing and have him/her sign the agreement.
If the name of the roommate is on the lease agreement, it may be difficult to get things done, but that does not seem that it is still possible to eject him/her in another way. Negotiate with the landlord to agree on a specific term in making him/her leave. Discuss the situation with the landlord, and try to get his/her approval regarding the settlement. It may be possible to get a new lease agreement specifying that only one party is the sole tenant, or look for a suitable replacement of roommate.
If the roommate is showing that he/she has no intention of leaving the room, become a nuisance to him/her. For example, if he/she is reading or watching the TV, turn on the radio and make the sound louder, but remember, do it playfully and do not ever argue. Bring friends inside the room and enjoy all the time, leaving mess in the sink, and dirty all over. Make the place uncomfortable and annoying for him/her just like the use of the Internet. If he/she is not paying for it, cancel its connection, or change the password of the Wi-Fi so that he/she could no longer log in. If there is only one TV shared by both of the roommates, bring it inside your room so he/she could not watch. If there is only one bath and toilet shared by you, take more time inside until he/she gets annoyed. There are many things that can be done to evict him/her on your own method, but just remember not to go to the extent of getting into an argument that could lead anyone to a crime. You can also bring your naughty nephew or niece in the room, and let the child spread out mess all over the area and play with noise.
Make everything hard for the roommate to satisfy you. Make requests that he/she could hardly meet. For example, ask him/her to not come home late at night perhaps after 10 pm because you want to sleep early, and if he/she comes late then they may wake you up with the noise they could make. Ask him/her to pay for the half of daily maid service that you intend to hire to maintain order and cleanliness in the room. If he/she is bringing some friends daily to have fun, ask him/her to stop it because they are noisy, and you are being disturbed in your school lessons. If he/she is snoring at night, it is a good excuse to have him/her leave the room. If he/she stays too long in the toilet, it is also a ground to tell him/her frankly. If he/she puts his/her dirty clothes anywhere, you can take it against him/her. There are many things that you can do to keep yourself out of his/her reach that will annoy him/her in the end, but remember always to keep your cool.
If you have gathered several reasons against the roommate that are grounds for eviction, then, render an eviction process. Supposing that the name of the roommate is indicated on the lease and he/she does not want to leave, then, try to get an eviction order. Do not fail to inform the landlord about the case, and explain the problems covering the case. It could be better if you take photos of the mess in your room caused by the other party, or if he/she has done any destruction in the room. If the other person has violated the terms stipulated on the lease, then, it would be easier to get hold of the room, but if he/she is also trying his/her best to accomplish things in his/her favor, the landlord might have second thoughts, and hold the two parties responsible. In this case, try to do everything to get the sympathy of the landlord, and explain why the other person should be evicted and not you.
It is always possible to get rid of a roommate who is not suitable to your taste without committing a crime. It could take some time before he/she would decide to finally leave the room for good, but there is always a chance to eject him. This problem is not new to tenancy cases where roommates are not comfortable with each other because of the so-called individual differences. There are even occupants who go beyond reasons and violating the law. However, just remember that the best way to come into terms is to render a diplomatic discussion before anything else. What more if you are not that hardened person to talk frankly with the other party or do things that will annoy him/her but deep inside you are also hurt because you were not brought that way, then it would be better to look for another room where you can live peacefully without hurting anyone.
