What is the Comprehensive Drug Abuse Prevention and Control Act?
In 1970, “Congress passed an act that would regulate the manufacturing, importation, possession, use and distribution of narcotics and chemicals used in the illicit production of controlled substances and provide a legal foundation of the governments fight against drugs and other substances” (Manubay, Muchow, & Sullivan, 2011).
History of the law(s)
The Federal Comprehensive Drug Abuse Prevention and Control Act of 1970, also known as the Controlled Substances Act (CSA). CSA is the Title II of the Comprehensive Drug Abuse Prevention and Control Act. CSA targets the governments war on drugs and it classifies drugs into five categories: Schedule I drugs are most dangerous i.e. Heroin, LSD, marijuana; Schedule II are drugs that have a high potential for abuse cocaine, meth, Demerol, Adderall; Schedule III these drugs such as Tylenol with codeine, Vicodin, or ibuprofen they range from a moderate to low potential for physical and psychological dependence; Schedule IV drugs are those that have a low potential for abuse and a low risk for dependence such as Xanax, Soma, Valium and Ambien; Schedule V drugs are those with the least contained quantity of narcotics. Mostly Schedule V drugs are those that can be found over the counter at the pharmacy. This law consists of 3 different titles. The first one “Title I deal with establishment of rehabilitation programs for drug abusers, Title II address the registration and distribution of controlled substances, and Title III deals with issues related to the importation and exportation of controlled substances” (Gabay, 2013). Anyone who manufacturers, distributes or dispenses any controlled substance must be registered with the Drug Enforcement Administration (DEA). The DEA is responsible for enforcing this Act.
The impact that the Act has on society?
This Drug Abuse Prevention and Control act of 1970 has impacted society because it helps the government to fight against drugs of abuse. CSA is a system that is in place to ensure that public health officials limit the access of controlled substances and ensure that all medications are truly accounted for. CSA also restricted access to controlled substances to those who were registered to manufacture, distribute, or dispense these items. Pharmacies must be registered for 3 years. CSÁ requires that pharmacies when they are receiving or transferring controlled substances they must put them on an invoice. They must record the dosage unit, number of units per container, and the strength. When distributing a controlled substance there is also a process whether its coming from one manufacturer to another, from a manufacturer to distributor and from distributor to dispenser. There is a Form 222 which must be filled out completely before anything can be shipped to a client with name and address of the customer.
Impacts on Counseling
When counseling an individual who may be suffering from an addiction. Its best to understand the history and legality of the Comprehensive Drug Abuse Prevention and Control Act of 1970. Comprehensive Drug Abuse Prevention and Control combined all the federal laws dealing with narcotics, stimulants, depressants, and abused designer drugs. Established a closed system, in which the distribution of controlled substances is permitted only between entities registered with DEA. -Made 5 Schedule Classes for drugs. By understanding exactly what the Act is intended for will help the counselor come with alternatives to help the client to overcome their addiction. The Act is basically there to help fight against the abuse and whatever other substances they may be addicted too.
Conclusion
The Comprehensive Drug Abuse Prevention and Control Act was intended to be a check and balances. This act is the reason why there is a such a strict bookkeeping when it comes to certain types of drugs. The main reason why they came up with these laws is to decrease the amount of people who are abusing drugs. Substance abuse in America is on the rise and is a menace that should be addressed by the federal government. It would take both the collaboration of the government and the society at large to solve this problem of substance abuse.
