Instructions
The purpose of this module is to help you develop the skills to anticipate and avoid potential pitfalls surrounding wage and
benefit laws that affect your organization. This project provides the opportunity to demonstrate these skills.
To complete this project, you will draw on your experience in a current or previous workplace. You may also research a
company of interest to you.
In Part One, you will determine which positions in your current organization or a previous organization are exempt and
which are nonexempt.
In Part Two, you will apply the leave regulations described in this module to the large and small organizations with which
you interact in your community, business, or workplace.
In Part Three, you will assess the retirement and medical insurance benefits at both a large organization and a small
organization.
Except as indicated, use this document to record all your project work and responses to any questions. At a minimum, you
will need to turn in a digital copy of this document to your facilitator as part of your project completion. You may also have
additional supporting documents that you will need to submit. Your facilitator will provide feedback to help you work
through your findings.
Note: Though your work will only be seen by those grading the course and will not be used or shared outside the course,
you should take care to obscure any information you feel might be of a sensitive or confidential nature.
Complete each project part as you progress through the module. Wait to submit the project until all parts are complete.

Part One
Determining Whether Positions Are
Exempt or Nonexempt
In this part of the course project, you will determine which positions in your current organization or a previous organization
are exempt and which are nonexempt.
Instructions
To complete this part of the project, you will describe positions in your workplace and explain whether they are exempt or
nonexempt using Department of Labor Fact Sheet #17A: Exemption for Executive, Administrative, Professional,
Computer & Outside Sales Employees Under the Fair Labor Standards Act (FLSA).
Part A – Identifying exempt vs. nonexempt
Describe two positions in your workplace that are exempt and two that are nonexempt, then explain your rationale for
thinking so. Refer to Fact Sheet #17A in your rationale.

Part B – Exploring nonexempt
Now take a moment to think more broadly about nonexempt positions in your current or a previous workplace to identify
those that might be required to work off the clock in terms of checking email, finishing in the evenings, etc.
1. Write one or two paragraphs in which you assess the liability exposure/potential for individual employees in
the nonexempt job categories you identified above to be asked to work “off the clock.”
2. What jobs are you aware of in your current or a previous workplace that involve situations where certain
nonexempt employees might be “waiting to be engaged” or “engaged to be waiting”? Describe those
situations and assess whether the employees could be using that time for their own activities. Explain
whether you think, according to the law, that these employees need to be paid for this time.

Part Two
Applying Leave Regulations
In this part of the module project, you will apply the leave regulations described in this module to the large and small
organizations with which you interact in your community, business, or workplace.
Instructions
To complete this part of the project, you will need to identify two large organizations and two small organizations with
which you are familiar in your community, business, or workplace.

organization they are. Then think about whether each organization would be required by the FMLA to provide leave

Instructions To complete this part of the project, you will need to review retirement and medical insurance benefit plans from both a large organization (50 or more employees) and a small organization (fewer than 50 employees). These may be organizations that you work for now or have worked for previously, or they can be organizations that are of interest to you. In either case, you will probably need to do some online research to locate these benefit plans.
