GREENMAN v. YUBA POWER PRODUCTS
FACTS
Shopsmith is a power tool that can be used as a saw, drill, or wood lathe. It was
bought by Greenman’s wife at Yuba Power which is the retailer but after two years, he
got seriously injured while using the machine when a piece of wood flew out and stuck
him on the head. A case was filed by Greenman against Shopsmith and Yuba Power. The
court favored Greenman but the case was appealed by the defendant.
ISSUE
In this case issue, whether or not the defendant is strictly liable by putting out a
defective product on the market that resulted in damages or injuries to a third party.
RULE
Case decision was, ” A manufacturer is strictly liable in tort when an article he places
on the market, knowing that it is to be used without inspection for defects, proves to
have a defect that causes injury to a human being”(p. 153, par. 04).
ANALYSIS
Greenman brought substantial evidence including expert testimonies that his injuries
were caused by defective product. Defective in regards with its design and construction
by Shopsmith. Putting such products on the market with defects should be
manufacturer’s liability because consumers are solely relying on the good quality of all
the products when it is already out on the market. Consumers are lack of expertise to
check or test whatever products they’ve got from the market so they are said to be
powerless to protect themselves if there’s some defects. If the caused of injuries are by
using the product that it was built to do, then the safety of the product when used are
misrepresented by the manufacturer.
CONCLUSION
Therefore, I conclude that because of misrepresentation of the product or because of
the defects, defendant is strictly liable in tort for injuries to the plaintiffs. Plaintiff is not
aware of the danger coming to him by using the defective product so someone should be
account liable on his injuries.
