Sara showed up to her job interview wearing a headscarf. At the interview, the employer asked Sara if she was going to wear the headscarf on the job. Sara said “yes, my belief system requires me to wear this.” The employer did not to hire her. Later, when asked why, the employer said that Sara was “not a good fit” and said “her headscarf clashes with our employee dress code which requires employees to dress in “classic East Coast collegiate style.” Sara then sued, saying the employer had violated Title VII the Civil Rights Act and committed an “unlawful employment practice.” Sara alleges that she is a practicing Muslim and wears the scarf for religious reasons.
