Reich agreed to buy a residence from Thomas. The contract contained no contingencies except for financing by means of a mortgage. Before the closing, Reich learned that the title was flawed because of a judgment against the property. He also discovered an easement for an overhead power line. Reich canceled the contract and refused to go ahead with the closing.
