Benefits of Implementing Artificial Intelligence Memorandum

Each student will write a double-spaced memorandum of at
least five pages to their future employer (real or imagined) on
the applications of electronic discovery, blockchain,
cybersecurity, or artificial intelligence(pick one) and how the
firm, government, public-sector, or other type of employer will
benefit from the application.
For the purposes of this memo, please assume that while your
employer has heard of these technical areas, they are
currently unaware of all the advantages associated with
implementing the technology at a higher level. As all good
lawyers understand, we are also bound to address any
possible negative aspects of the technology to the employer.
Regarding the employer, you can address the person as
managing partner, or if a public sector position, a department
head or Director of something.
Taking some examples from the articles placed near the end of
the syllabus should be helpful for your paper. These articles
are for the most part recent, within the last year or two and
still applicable. Pick one of the four areas with the
understanding that some areas may bleed into one
another and that is fine, For example, you want to write on
predictive coding software (EDiscovery), and how that is
important for your future employer with the understanding
that most predictive coding incorporates A.I.
A template you may consider: First, explain why a lawyer
in the specific law firm you will be working (or may be
working), or public sector, or judge’s chamber, or corporate
job, the list is endless, should care about the technology
(i.e., Blockchain). Second, describe the basics of the
technology from that 5,000-foot vantage. Third, provide the
laws. Almost all states legally address these four different tech
areas, some more than others. There are relevant state and
federal statues and state and federal regulations in the vast
majority of jurisdictions.
If your state seems to be a little deficient on laws regarding
your tech topic, you should look at congressional bills, state or
federal, that failed or are in the current session, case law
involving sanctions and ethical opinions are all relevant to
include in your memo. Fourth, describe the lawyerly
application of the technology. Will there need to be experts
involved? Will you need to contract out some parts to make
the technology work. What will make sense? Are you going to
be a one-person shop, a small firm, medium sized, a Big
Law? The same for other types of public sector jobs. There is
small or big or in between. Most Big Law is tech savvy, but

Costs for a small firm may be prohibitive compared to a larger
firm? Fifth, one concluding, summary paragraph picking out
two, or three, at the most, reasons why the technology, or an
upgrade in the technology (you will need to lay out where the
employer currently sits on the tech area you are writing on.) If
you do not know make something up. If you aren’t, sure you
may want to go beginner for small firm or GP. For the other
employers I would suggest they are light users, dabblers, and
you can tell them how to best use the technology. If its Big Law
you may need to address a niche, (see article noted above and
below.)
If you are going Big Law but are having issues with addressing
tech in Big Law bring it down a level or two. Be flexible. The
important thing is you working with technology, where it is in
2023 and how is it being used in legal practice.
