LEG100 – Week 11 Discussion – Business Law Concepts
Part 1
- Law is always evolving. It slowly changes over time in response to its environment. In business, new types of products, services, and practices drive the development of law, forcing it to adapt to situations we can’t even think about today. A great example is the gig economy created by companies such as Uber and Lyft and their do-it-yourself ride service. What new developments do you think will present the need to rethink and re-evaluate how business law concepts apply today or in the future?
Part 2
Respond to one of your classmates with a comment, suggestion, or comparison (Tracey O’N.).
Hello Everyone,
The increasing incorporation of Artificial Intelligence (AI) and automation into business operations necessitates a thorough examination of the associated legal ramifications, particularly in the areas of liability, intellectual property, and employment law. A critical challenge lies in determining liability when an AI system’s decisions result in legal conflicts, which can be quite complex. This issue extends to developers in cases where the AI system malfunctions or makes incorrect decisions due to design or programming errors, users when the AI is misapplied or used beyond its intended scope, and manufacturers if the AI hardware fails to meet expected performance standards. In relation to employment law, the implications of AI encompass several key areas: Bias and Discrimination, where AI systems used in recruitment must adhere to anti-discrimination laws, placing the onus on employers to ensure these technologies do not perpetuate bias; Job Displacement, as the rise of automation may lead to workforce reductions, prompting organizations to consider reskilling initiatives; and Data Protection, where employers must safeguard employee data processed by AI systems and comply with relevant data protection regulations. To effectively address these challenges, it is essential to establish a strong legal framework, implement clear policies, and maintain ongoing oversight to ensure compliance and mitigate potential risks.
