Read the material in Chapter 8 on page 225 – 229 regarding contracts that must be in
writing.
Answer and comment on the following scenario:
John decides he wants to own the Denver, Colorado Frito Lay franchise. He makes and
inquiry to Frito Lay, and they are excited to have him apply. Mary, the Frito Lay
executive in charge of the Denver area, tells John he as a great chance of approval, but
he must lease a space for the shipping. In reliance on Mary’s request, but before signing
any contract, John leases the space. A few weeks later, John and Mary discuss the
potential franchise again, and Mary indicates to John that “Listen, the franchise is yours,
but you need to buy two trucks.” John does so, but still there is no contract between
John and Frito Lay. After a few weeks, Mary informs John that Frito Lay has decided to
contract with another franchisor and John will not get the Frito Lay franchise in Denver.
John protests, but Mary points out, correctly, that John does not have a contract with
Frito Lay.
Does John have a case against Frito Lay? Why or why not?
