Kennedy vs Bremerton school. A case where the head football coach prayed with his team at the 50 yard line after games. He was then later told that he could no longer pray after the games because the school was scared of them getting a lawsuit against them. He refused to stop and was then later suspended because he did not comply.

ISSUE: In this case was Kennedy’s First Amendment right violated by not letting him pray at the 50 yard line?

THAT IS THE QUSTION:

Now that your topic and issue statement has been approved, please submit the rule(s) of law associated with your case, including citation(s) and all required elements. Be sure to also consider possible defenses raised by the court (or by your group if the case has not yet been adjudicated).

For example, let’s say your group is presenting on an illegal search by a government entity.

The relevant rule of law would be the 4th Amendment. The proper citation is: “

U.S. Const., amend. IV

“. (Again, review Chapter 1 of your text if you have no idea what a citation is. Google is also a good source to help craft the citation.)

Thus, my Rule submission would look like this:

U.S. Const., amend. IV

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized”

*Please note-

1. Pay close attention to the relevant rule of your case. If your case is based off a state statute, e.g. fraud in Minnesota, you should be citing to the actual state statute.

2. If your rule of law is embedded in a large Act or Legislative Bill, it’s ok (and appropriate) to mention the name of the Act, but then you must cite specifically to the relevant section of the Act that pertains to your case.

3. If your case relies on common law, be sure to state the case name that is being used as the precedent and the proper full citation.
