UAB Wheels Case Discussion

You are driving your awesome ____(fill in this blank with your dream car)_________  (Precious) down University Boulevard, minding your own business, obeying all traffic laws, when you are suddenly BLINDSIDED by the Defendant driving his My Lovely car.  Your Precious is TOTALED, but Defendant’s car has only a small dent and a flat tire.  You are devastated by your loss and want revenge.  You  vow to sue Defendant.

You go see Larry Lawyer, but he refuses to take your case on a contingency basis because (1) Defendant lives in his parents’ basement and his only asset is his X Box, and (2) Crazy Larry Lawyer dares to doubt whether Defendant was actually at fault.  Larry will take the case on a billable hour basis, but his rate is $400 per hour.

Should you hire Larry Lawyer?  Why or why not? Is there any risk to suing Defendant?  What could possibly go wrong?
