Assignment Brief:
One day Homer is on the website AdvertDeal. He sees an advertisement on the site which reads:
“Moe’s Amazing Furniture Deals – If you come down to my store on Sunday morning at 9:00
am on the 20th January 2022 with €100, I promise to sell you furniture normally worth €500 for
€100!. This is on a first come, first serve basis.”
Homer is really excited about this offer because he just moved into a new house and needs new
furniture. He decides that he’s going to go to the store as advertised so, on the morning of the 20th he
turns up at 9:00 am with €100 and he is the only person waiting. Homer thinks he’s definitely going to
get the offer because he’s the first and only person present.
Homer approaches the manager of the store named Selma and explains he is here to answer the
advertisement on the website and collect the furniture for €100. Selma tells Homer that because of a
lack of response by the general public to the advertisement, Moe’s Furniture is no longer offering what
was in the advertisement. Homer is bitterly disappointed and tells Selma that Moe’s Furniture clearly
made an offer but Selma, who has a law degree says: “I think you’ll find that the law says that such
advertisements are invitations to treat, not offers.” Homer never studied law so he can’t argue with
Selma and he exits the store.
Requirement:
Advise Homer whether the advertisement amounts to an offer or an invitation to treat. You should use
case law and legal principles when explaining your answer.

Lecture slides are not credible sources of theory or fact but merely indicators of
the syllabus, theory and content, and therefore should not be cited.
The original source for theory and facts should be traced to the relevant
academic articles or other reliable sources, which are then cited.
Sources
The citations for these sources can be found within the slides or indeed the
assigned reading material, but only sources that the student has actually read
can be cited.
If the student cannot find the original version of a source that has been referred
to in a book or article, then they should cite it as secondary source, for example
as follows:

Marking Scheme:
Structure (10%)
Marks will be awarded for the use of the appropriate structure, ILAC, using headings, numbering,
logical sequencing of material etc.
Methodology (20%)
Marks will be awarded for the use of appropriate methodology to gather reliable information from
appropriate secondary data
Content (50%)
Marks will be awarded for clear interpretation and understanding of material, and why and how
information is gathered, processed and used within a business context
Referencing (10%)
Marks will be awarded for the correct use of the approved referencing system e.g. the Harvard
Referencing System – Students who completely fail to use the referencing system appropriately may
receive 0%
Conclusions (10%)
Marks will be awarded for conclusions that demonstrate rigorous and insightful analysis of the
secondary data
