Decisions/Conclusions:There are many suggested ways and decisions that can be taken to reduce or eliminate the
bar violence completely.
•
Dome must consider voluntarily ending the deep-discount drinks. This may play a
part in reducing the number of people who are drinking.
•
Better control and security system within bars and nightclubs.
•
Appointing better and well trained security guards to prevent violence from taking
place or escalating inside the bar.
•
Bar owners should consider lifetime ban to the people who are creating troubles.
•
Number of video surveillance cameras in the bars and nightclubs must be increased.
•
Bar owners must ensure that no service is provided to the ones who are impaired.
The main motive is to pro-actively address the problem identified by the Government and
take necessary steps to reduce it. Otherwise, legislation can be ensued.
As part of getting the liquor license back, Dome and other local bar owners must commit to
ending the $1.00 drinks, installing more cameras, lifetime ban to troublemakers,
appointing better and well trained security guards as well as:
•
Limiting the number of buyers to 80-85% of the bar capacity.
•
On a busy night, hire double number of police officers than a normal night.
•
Increase the number of security staff inside the bars.
•
Appointing a consultant for improved security training.
•
Increase the number of cameras inside the bar and allow police to have access of
them.
When it comes to lifetime ban for troublemakers then it should be the bar owners
who should set up an example.
From a risk management perspective, if the local bars follow the ways discussed
above then they can reduce the Government concern over bar violence.

Group Case Assignment Guidelines
Group Case Assignments are to be submitted via the drop boxes provided on
the Brightspace course website by 11:30 PM (Atlantic Time Zone) on the due
date shown on the class schedule. They should not be more than 4 pages in
length (double spaced, 12 point font, normal margins).
In general, you and your group should follow the 6 step process below in
preparing written case analyses:
Step 1: Carefully read the case, making sure you understand it fully;
Step 2: Identify the area of law involved and the legal issue(s) presented;
Step 3: Set out the elements or requirements that must be shown to address
the legal issue(s);
Step 4: Analyse the case to determine whether each required element or
requirement is present regarding each legal issue raised by the case;
Step 5: Sometimes it is also necessary to analyse whether there are defenses
available that would eliminate or reduce the amount of liability – include this
in your analysis; and,
Step 6: Present your decision(s)/conclusion(s), showing that they are based on
(and consistent with) your analysis.
Some of the Assignment Cases have specific questions that are asked at the
end of the case. You should be sure to address these in presenting your
analysis and conclusions.

Group Case Assignments
Group Case Assignment 1 - Due January 24, 2022, 11:30 PM ADT
Situations for Discussion, No. 2 @ p. 54 (Chapter 2) of the Duplessis textbook
(Full text of the case, quoted from the textbook):
“A brawl at a popular Halifax nightclub called the Dome resulted in 38
arrests and the suspension of the Dome's liquor license. Government
officials believe that one-dollar drinks offered by the Dome are one factor
contributing to such violence. This has blown into a cultural problem,
and one of the issues we have identified is low-price, deep-discount
drinks,' said Barry Barnet, then Nova Scotia's Minister of Health
Promotion and Protection. The Nova Scotia government expressed its
hopes to develop recommendations to address problems associated with
excess alcohol consumption. From a risk management perspective, how
should local bar owners approach governmental concern over bar
violence?"
Group Case Assignment 2 - Due Februrary 14, 2022, 11:30 PM ADT
Situation for Discussion No. 3, at page 281 (Chapter 11) of the Duplessis
textbook (Full text of the case, quoted from the textbook):
“Klutz won a contest sponsored by a radio station, entitling him to play in
a twilight golf tournament. He went to the radio station and signed a
form releasing the station from any liability connected with the
tournament. The event was held at the Dark Side Country Club, beginning
at 11:00 PM. Klutz attended a pre-tournament instructional meeting and
was told that his team was to tee off on the second hole. While his team
headed for that spot, Klutz hurried to his car to get his clubs and golf
shoes. As he sprinted down the path to the parking lot, he ran into one of
