Specific Purpose: By the end of my speech, the audience will be better educated on sexual harassment in the work place

Central Idea: Sexual harassment is disguised and if not fully aware of the dangers of sexual harassment, you may fall victim or worse, offender.

I. Introduction

A. Attention-getter/Grabber: I use to be an Assistant General Manager at Taco Bell. I saw employees do things to one another without them seeing me. I witnessed hand grabbing, pants pulling, back rubbing, and many more things that if a customer would have saw, may have been offended by such behavior. I have always wanted to better educate myself on “What exactly is sexual harassment?” but I never witnessed it like before. Many people at work places are not aware of the thin line between a friendly gesture and even kind words versus sexual harassment.

B. Thesis and Preview of Main Points:

Today we will discuss:

1. First, what is sexual harassment

2. Secondly, how does it affect employees

3. Third, where to go if you have been sexually harassed at work

C. Credibility: My main sources were a research I did over the internet and a phone call interview with a Public Service Officer in my local area.

II. Body

A. Let’s begin by answering the question:

”What is sexual harassment?”

According to Stop Violence against Women, a website I researched online, sexual harassment is defined as: and I quote “such unwelcome sexually determined behavior as physical contact and advances, sexually colored remarks, showing pornography and sexual demands, whether by words or actions.”

1. Who can be sexually harassed?

a) According to the Minnesota’s Advocate for Human Rights, many people are misled to only thinking that men are the only sexual harassers at work. But to our surprise, an offender can be male to male, supervisor to employee, non employee such as a vendor to an employee, women to male, and third party sexual harassment.

b) In the U.S. Equal Employment Opportunity Commission Guide, a simple tease at work is not illegal, but when it goes further and without any signs of stopping, it becomes sexual harassment.

c) Any persons who feels uncomfortable at work because of what was said in a sexual manner that was offensive to that particular employee, is considered sexual harassment.

2. What are the penalties for workplace sexual harassment?


Termination
: According to the Houston Chronicle, and I quote, “When an employee brings a workplace harassment suit against a company where he works or worked, it is the company, not just the offender, who faces legal consequences. For this reason, most organizations have a specific policy regarding workplace harassment, which stipulates what is considered harassment, how to report harassment and the punishments for harassment. If the harassment is severe or happens more than once, an employee may be fired. For example, in cases of “quid pro quo” sexual harassment, when a person in a supervisory position offers some sort of employment benefit in return for a sexual favor, termination is a logical punishment.”


Embarrassment
: I think it would be embarrassing to be called into an office with your supervisor and the person you just offended to discuss the nature and offense of the actions that took place.

Jail Time: According to the Houston Chronicle, Harassment is a criminal charge, and the victim could press criminal charges, the person who committed the harassment may face jail time. The amount of jail time, probation or community service the convicted harasser receives could be based on whether the harassment was a misdemeanor or a felony and in what state the crime was committed.

Transition: Do not sexually harass anyone at any time.

B. Who to talk to about you being sexually harassed at the workplace?

1. The Chicago Now.com is a website where authors go and publish their stories. According to Author Terri Lee, Ryan, she was sexually harassed by a supervisor and didn’t know what to do. She went to the HR Department at her place of employment and they handled the situation accordingly. At any place of employment, you are authorized to talk to someone at the HR Department if you are having problems with a Lead or a Supervisor.

2. According to PSO Pricilla for the Killeen Police Department, if you were physically touched by the offender at work, then you can call your local police department according to Penal Code Assault by Contact, and your local police department will assist. If they did not physically touch you, you will have to go to the HR Department for the employer you work for and file a claim.

3. You can always report the initial harassment to your first line supervisor or even a coworker if you feel that you can trust them.

III. Conclusion

A. Recap/Summary/Review
Today, we have looked at how serious sexual harassment is in the workplace. We looked at:

1. First, we learned the definition according to Stop Violence against Women, of sexual harassment. Who can be sexually harassed?

2. Secondly, we talked about the punishments of sexual harassment in the workplace.

3. And finally, we learned who to talk to if you have fallen victim of workplace sexual harassment.

B. Clincher/Memorable Statement

I would like to leave you with a true story of a sexual harassment case file against a higher authority by one of his employees.

Paula Jones/President Bill Clinton

“Staying in the realm of the government, President Clinton himself came under fire for alleged sexual harassment. Paula Jones was a state employee when Clinton was Governor of Arkansas. In 1991, she claimed that Clinton exposed himself and asked her for oral sex in a hotel room. Clinton denied all allegations.

After several rounds of filing, Jones’s lawsuit was dismissed for failing to state a claim. During the appeals process, a settlement was reached. Jones dropped her suit against Clinton in exchange for $850,000. However, she never received an admission of guilt or an apology.

Jones’s allegations paved the way for investigating the President’s sex life. The Monica Lewinsky scandal and the impeachment of President Clinton were big follow-ups to the Paula Jones case.”(LegalZoom.com)
