Jane Schmidt, who was working in the research and development department at BAT, moved to JAM’s research facility in Germany six months ago and he is concerned that Jane may have taken sensitive data from BAT.1. How would you go about investigating your supervisor’s concerns?2. Given that Jane Schmidt is now located in Germany, what issues might you face at discovery if litigation ensues?3. Consider Cross-Border data transfer issues e.g. The EU Directive and Safe Harbor.Prepare a report that includes both a summary of actions you recommend should be undertaken to address his concerns and a summary of relevant cross-border litigation issues that he needs to be aware of. You can make any reasonable assumptions to complete your report, as long as you indicate that your assumptions are supported by fact based resources (this is not an opinion project, suggestions have to be supported with resources).
